Website Terms and Conditions of Use
This document establishes the terms and conditions governing the use of the Website and the rights of Website users. In addition, when a user places an order, this document constitutes a contract between the user and MEKALOI.
Definitions of Key Terms
The terms used in this document have the following meanings:
Platform - the e-commerce website www.mekaloi.ge.
Goods - products offered through the Website.
User - any person who uses the Website, including a Website visitor, a person placing an order, and a recipient of services.
Intermediary - a person providing intermediary services in accordance with the Law of Georgia on Electronic Commerce.
MEKALOI - the owner and legal administrator of the Website, Individual Entrepreneur Ketevan Mekalishvili, Identification Number 45001033278.
Introduction

Users may purchase Goods through the Website throughout the territory of Georgia.

If the MEKALOI Website acts as an intermediary, it is responsible both for damage caused by the
courier during the transportation of Goods, including loss of or damage to the Goods, and for damage caused by a malfunction of the Platform that results in a violation of the rights of a service recipient under the laws of Georgia on Consumer Rights Protection and Electronic Commerce.
User Account

Creating an account or profile is not mandatory in order to fully use MEKALOI services.

To open an account, the user must follow the instructions provided on the Website, provide the
requested information, and, where necessary, complete verification.

Before creating an account, the user must ensure that doing so does not violate Georgian law or the
rights of third parties.

The user is fully responsible for the accuracy of the information provided when creating an account.

MEKALOI

MEKALOI reserves the right to request additional confirmation of the accuracy of information provided on the Platform.

User data will be processed in accordance with the MEKALOI Privacy Policy and applicable law.

MEKALOI users may register and create an account using Google or Facebook. In such a case, the
user must also agree to the terms and conditions of Google and Facebook, and the user is responsible
for complying with those terms and conditions.

The user is responsible for keeping account credentials secure.

If the user suspects that a third party has gained access to the account, the user must immediately
change the account credentials or contact MEKALOI.
-
MEKALOI reserves the right to cancel a user account in the event of a serious violation of Georgian law
or this document by the user.
Orders

Any user may place an order on the MEKALOI Website.

To place an order, the user must follow the instructions provided on the Website.

Before the order is finally submitted, the user may identify and correct any error made while placing the
order.

When a user places an order electronically, the trader will immediately confirm receipt of the order by
electronic means. In particular, the user will be notified through the Website that the order has been
placed.

After receiving the order, MEKALOI begins processing it.

MEKALOI reserves the right to cancel an order where there is an objective reason for cancellation,
including suspected fraud, software or technical errors, or similar circumstances.
Payment Methods
Payment for orders placed through the MEKALOI Website may be made only by:
Visa card;
Mastercard.
Order Acceptance and Delivery

The user may use courier delivery services.

MEKALOI arranges delivery of the user's order to the requested address through a courier company.

MEKALOI is responsible for damage to an item during transportation.
-
Orders are delivered within Tbilisi in 1 to 3 business days.
-
Orders are delivered to other regions of Georgia in 1 to 7 business days.
-
In rare cases, MEKALOI may require more time to process an order than specified in these Terms and
Conditions, but no more than 10 calendar days.

The user will be informed of such a delay in advance, before purchasing the Goods.

Upon receiving an order, the user must inspect the Goods and ensure that they correspond to the order
and have no visible defects.

If a product has a visible defect, the user should not accept it and must immediately contact MEKALOI
at +995 557 566 866.

Before the order is dispatched, delivered to the address, or the delivery process begins, the user has
the right to cancel the order.

To cancel an order, the user must contact MEKALOI at +995 557 566 866.

Statutory Warranty

Statutory warranty terms apply only to users who are natural persons.
-
If the Goods are defective, the consumer has the right to request that the seller remedy the defect,
including by:
-
repairing the Goods free of charge;
-
replacing the Goods;
-
reducing the price;
-
withdrawing from the contract.
-
-
Repair and replacement of the Goods are the consumer's primary remedies.
-
The consumer has the right to require the trader to repair or replace the Goods free of charge, unless
this is impossible due to the nature of the Goods or would require disproportionate or unreasonably
high costs.
-
The Goods must be repaired or replaced within a reasonable period so that the consumer does not
experience a significant delay, taking into account the nature of the Goods and the purpose for which
they were purchased.

Repair or replacement of the Goods free of charge means that the seller bears all necessary costs,
including:

postal costs;
-
labour costs;
-
material costs.

The consumer has the right to request a reduction in the price of the Goods or to withdraw from the contract if any of the following conditions applies:
-
the Goods cannot be repaired or replaced;
-
the trader did not repair or replace the Goods within a reasonable period and the consumer lost
interest in performance of the contract;
-
repair or replacement of the Goods by the seller would cause a significant delay for the consumer.

Upon withdrawal from the contract, the consumer may request termination of the contractual obligations and restoration of the original position, as applicable.
Warranties Relating to Services

MEKALOI undertakes to provide services to users in accordance with Georgian law.
-
A service means any service provided by MEKALOI to a user, including courier services.
-
If a service is defective or delayed, the user must provide MEKALOI with a reasonable additional period
to perform the service or remedy the defect.
-
An additional period is not required where:
-
remedying the defect is impossible due to the nature of the service;
-
remedying the defect would require disproportionate or unreasonably high costs;
-
it is clear that granting an additional period would have no effect;
-
the user linked performance of the contract to receiving the service on time.

If the additional period expires without a satisfactory result, the user has the right to:
-
request an appropriate reduction in the price of the service;
-
withdraw from the contract;
-
claim damages in accordance with the procedures established by Georgian law.

If the trader did not begin providing the service on time, or if the service was unreasonably delayed so that completion within the agreed period became impossible, the trader may not demand reimbursement of costs incurred in the course of providing the service.

The trader may also not demand payment for services already provided if the user has lost interest in partial performance of the contract.

MEKALOI provides warranty services directly.
-
The fee for an unfounded service call, including transportation costs, is GEL 30 (thirty).
Commercial Warranty
-
In addition to the statutory warranty, specific Goods may be covered by a commercial warranty.
-
The terms of any commercial warranty will be stated in the description of the specific product.
-
A commercial warranty does not limit the statutory warranty rights.
Return Policy
-
Pursuant to Article 13 of the Law of Georgia on Consumer Rights Protection, the consumer has the right to withdraw from the contract and return the Goods within 14 calendar days after receiving them, without stating any reason.
-
To exercise this right, the consumer must complete the Goods Return Form.
-
When returning Goods, the consumer must:
-
return the Goods to the trader or to a third party designated by the trader immediately after sending notice of the return, but no later than 3 calendar days;
-
pay the direct costs associated with returning the Goods;
-
deliver the Goods to the following address: 1 Merab Aleksidze Street, Tbilisi, Georgia.

The seller will arrange and cover the return of the Goods where:
-
the characteristics of the Goods do not correspond to the information stated on the Website;
-
the Goods have an original defect;
-
the Goods are damaged.
-
-
The consumer must return the Goods in full, together with all accompanying documents.
-
The trader must refund the amount paid by the consumer within 14 calendar days after receiving notice
of the return of the Goods.
-
The trader may withhold the refund until:
-
the Goods have been returned; or
-
the consumer provides proof that the Goods have been dispatched, whichever occurs first.
-
-
The refund will be made using the same payment method used by the consumer, unless the consumer
agrees to another payment method.
-
The consumer's withdrawal from the purchase of the Goods automatically results in withdrawal from the
related contract and restoration of the original position.
Cases in Which an Unconditional Return Is Not Available
The consumer does not have the right to withdraw from the contract and unconditionally return the product if:
-
the price of the delivered Goods depends on fluctuations in the financial market that cannot be controlled by the trader and that occurred within the period specified in this document;
-
the Goods were made or produced according to the consumer's individual order;
-
the delivered Goods are perishable or have a short shelf life;
-
due to their characteristics, the delivered Goods became inseparably combined with other Goods
during delivery;
-
the value of the Goods does not exceed GEL 30.

Submitting a Request
To submit a request, the user must complete the relevant form or contact MEKALOI through one of the following communication channels:
Promotions and Discounts

MEKALOI may offer promotions and discounts from time to time.

Only registered users may benefit from a promotion or discount.
-
The terms of each promotion are determined individually.
-
Before participating in a promotion, the user must review its terms through the Platform.
-
Participation in a promotion automatically means that the user agrees to the applicable terms.
Intellectual Property Rights
The user must not take any action that infringes the intellectual property rights owned by the Platform or by any third party.
